Spain: European Court Approves Summary Deportations of Illegal Migrants

In a landmark decision that will have potentially seismic implications for immigration policy in Europe, the European Court of Human Rights (ECHR) has ruled that Spain acted lawfully when it summarily deported two migrants who illegally tried to enter Spanish territory.

The Strasbourg-based court — which has jurisdiction over 47 European countries, and whose rulings are binding on all 27 member states of the European Union — ruled that in order for migrants to benefit from certain human rights protections, such as access to lawyers, interpreters and the right to remain in Europe, they must first enter European territory in a legal, as opposed to an illegal, manner.

The ruling, which effectively authorizes European governments summarily to deport illegal migrants immediately at the border, transfers some decision-making powers on immigration back to European nation states. The ruling is being viewed as a major victory for those who believe that sovereign nation states have the right to decide who is and is not allowed to enter their territory.

The Spanish case dates back to August 2014, when hundreds of migrants from sub-Saharan Africa stormed the border fence at Melilla, a Spanish exclave in North Africa. After spending several hours perched on top of the fence, two men, one from Ivory Coast and the other from Mali, climbed down and were handcuffed by Spanish border police, who handed them over to Moroccan authorities.

The two Africans said they were never given a chance to explain their personal circumstances or receive help from lawyers or interpreters. In February 2015, with the help of human rights lawyers, the pair took their case to the ECHR.

In October 2017, the ECHR ruled that summary deportations were a violation of European law. The Court determined that Spanish border police had failed to verify the identity of the migrants, or to provide them with access to lawyers, translators or medical personnel. It ordered Spain to pay each of the men €5,000. In December 2017, Spain's previous center-right government appealed the ruling.

On February 13, 2020, the ECHR unanimously reversed its previous judgment. In a statement, it explained:

"The Court considered that the applicants had in fact placed themselves in an unlawful situation when they had deliberately attempted to enter Spain on 13 August 2014 by crossing the Melilla border protection structures as part of a large group and at an unauthorized location, taking advantage of the group's large numbers and using force. They had thus chosen not to use the legal procedures which existed in order to enter Spanish territory lawfully. Consequently, the Court considered that the lack of individual removal decisions could be attributed to the fact that the applicants — assuming that they had wished to assert rights under the Convention — had not made use of the official entry procedures existing for that purpose, and that it had thus been a consequence of their own conduct.

"In so far as it had found that the lack of an individualized procedure for their removal had been the consequence of the applicants' own conduct, the Court could not hold the respondent State responsible for the lack of a legal remedy in Melilla enabling them to challenge that removal."

The ECHR added that the two men could have applied for visas, or for international protection, at an official border crossing or at Spanish embassies or consulates in Morocco or in their home countries.

The ECHR's decision has been greeted with outrage by human rights groups and other proponents of uncontrolled mass migration to Europe. Amnesty International, in a statement said:

"Today's judgment is very disappointing. These two men were marched back to Morocco as soon as they entered Spain, with no chance to explain their circumstances, no chance to request asylum, and no chance to appeal their expulsion.

"That the court has today decided that Spain was within its rights to do this, because the men entered the country irregularly, is truly a blow for refugees and migrant rights. People must have access to asylum procedures and to appeal any decision, regardless of how they entered the country they wish to seek sanctuary in."

Wolfgang Kaleck, General Secretary of the European Center for Constitutional and Human Rights, said that the ECHR's ruling will be perceived as a "carte blanche" for summary deportations elsewhere in Europe:

"Push-backs at the border to Morocco are a longstanding Spanish practice, which has become a model for other states along the European Union's external land borders."

Writing for the constitutional law blog, Verfassungsblog, Spanish lawyer Carlos Oviedo Moreno, accused the ECHR of racism:

"The ECHR...distinguishes between legal and irregular entry into the territory of a State and attaches to it the consequence of placing some people outside the protection of the European Convention on Human Rights....

"The consequence of such reasoning is perpetuating borders as no-rights places for very particular groups: (black) migrants, people from the Global South, the undesirable minority excluded from the benefits of global free movement encouraged for everybody else."

Others welcomed the ECHR's decision. "Borders must be defended," said the Mayor-President of Melilla, Eduardo de Castro, of the libertarian party, Ciudadanos (Citizens).. "Countries must defend their sovereignty and territory."

Officials in Ceuta, another Spanish exclave in North Africa, also welcomed the ECHR's decision. Alberto Gaitán, spokesman for the Ceuta government, which is led by the center-right Popular Party, said:

"The ruling protects our right and obligation to preserve and defend the integrity and inviolability of our border as well as the actions carried out by our border police and national police, who have our respect, backing and support."

Congresswoman Teresa López, who represents Ceuta for the conservative party Vox, the third-largest party in Spain, added:

"The ECHR has sided with common sense in the defense of a well-defined border, which is one of the essential conditions for the stability of any state. The court has responded with common sense to the fact that the massive and violent assaults on the borders of Ceuta and Melilla are collective actions in which the assailants consciously and voluntarily place themselves in a situation of flagrant illegality.

"In reality, the so-called express deportations consist of each country being able to defend its borders and its inhabitants with all the legal and proportional means at their disposal. Since its creation, Vox has called for Spanish police and border guards to be provided with all material and legal means to protect the Spanish border."

Vox parliamentary spokesman Iván Espinosa de los Monteros described the ruling as "a victory for Spain and for the rule of law." He added:

"The ECHR's ruling determines that a nation state has the right to defend its borders. When someone is dedicated to violating those borders, the nation state has the right to return that person to their place of origin as quickly as possible."

It remains unclear if the ECHR's ruling will have a deterrent effect.   • July 26, 2018. At least 800 migrants from sub-Saharan Africa tried to scale the fence at Ceuta. A total of 602 managed to enter Spanish territory. The migrants used unprecedented violence against Spanish law enforcement. Eleven police officers were injured when migrants attacked them with quicklime, homemade flamethrowers, sticks and sharp objects, as well as with urine and excrement.
  • August 22, 2018. A total of 119 migrants successfully scaled the fence at Ceuta, after taking advantage of a diminished police presence on the Moroccan side of the border during a Muslim holiday.
  • October 21, 2018. More than 300 migrants tried to scale the fence at Melilla; 200 migrants, mostly from sub-Saharan Africa, successfully entered Spanish territory.
  • May 12, 2019. More than 100 migrants tried to scale the fence at Melilla; 52 migrants, mostly from Cameroon, Ivory Coast and Mali, successfully entered Spanish territory.
  • August 30, 2019. More than 400 migrants tried to scale the fence at Ceuta; 155 migrants, mostly from sub-Saharan Africa, successfully entered Spanish territory.
  • September 19, 2019. At least 60 migrants tried to scale the fence at Melilla; 26 migrants, mostly from sub-Saharan Africa, managed to enter Spanish territory.
  • November 18, 2019. A people smuggler transporting 52 migrants — 34 men, 16 women and two children — reached Spanish territory after driving his van at full speed through the border gate at Ceuta. The driver, a 38-year-old Moroccan with French residency, was arrested more than a kilometer inside Spanish territory. The migrants, who claimed to be from Congo, Guinea and the Ivory Coast, were taken to a migrant processing facility in Ceuta.
  • January 19, 2020. More than 250 migrants tried to scale the fence at Ceuta; two dozen migrants and police officers were injured.

Spain's new government, comprised of a coalition of Socialists and Communists, recently removed razor wire, known as concertina wire, from the border fences along Spain's frontier with Morocco. The government ordered its removal after migrants who tried to jump the fences suffered injuries from it.

Police and border patrols agents have warned that without concertina wire, the border will become even more vulnerable to mass incursions than it already is.

Vox leader Santiago Abascal said that the government's plan was part of a broader effort to undermine national sovereignty in favor of globalist mass migration. He called for replacing the fences with concrete walls to secure the border better:

"The borders in Ceuta and Melilla are permanently violated by avalanches of immigrants. We are going to propose a reform of the immigration law to be able to expel an immigrant immediately if his documentation is not in order. We believe that the best protection is a concrete wall that is high enough for security forces to control the border."

Espinosa de los Monteros blamed the government for encouraging mass migration. "We are not against immigration," he said during an interview with Spanish public television. "We are not even against the illegal immigrants. It is not their fault that an irresponsible government has called them to come here illegally."

At the time of independence the English were our main enemies. So we were united against them. But with independence we began fighting each other.
Partition is not a crime. We were never one nation and partition comes naturally to us.
America is a democracy with a common language and common culture and religion. In contrast we have too much of diversity. However in America the states have far more independence than we have with their own constitution and flag. What is more they have a longer tradition of democracy. In contrast we have too much of centralization which is not condusive to a democracy like ours. In addition, we are still learning the ropes reg democracy.
Just as economics has its own logic and laws, politics also has its own laws and logic. According to these laws, political movements which help in economic progress will only survive and evolve. If a centralised economy is condusive to prosperity it will flourish. But we know that small nations like Singapore are more flexible and progress much faster than large and sluggish states like India or Russia. So whether we like it or not India will split up into states or nations unless we decentralize and give the districts and states their due.

Here is a question. If you stood at New Delhi Railway Station and spoke to 7000 randomly chosen people, how many BJP supporters would you meet? Going by the BJP's 38.5% vote share in the just concluded election, a decent estimate would be around 2700 people. The real number, of course, could be a bit higher or a bit lower.

How much higher or lower could it get? Could it be that 6000 of them were BJP supporters? Could it be that just 1000 of them were BJP supporters? Both would be surprising.

How about this? What if there were just 5 BJP supporters among 7000 people you meet in Delhi. That sounds near impossible, right?

These are the party positions after 14 rounds of counting at Mustafabad seat in Delhi. You can see that BJP candidate and sitting MLA Jagdish Pradhan has raced to a near 30,000 vote lead over his AAP rival. In an Assembly election, a lead of 30,000 would be considered fairly decisive. It would seem that Mr. Pradhan was on his way to retaining his seat comfortably.

And then something incredible happens between Round 14 and Round 23. Here is Round 19 for instance.

In this round, AAP's Haji Yunus has received 7904 votes to just 36 for the BJP! WHAT? How?

This trend continues all the way between Round 14 and Round 23. Each time AAP's Haji Yunus piles on thousands of votes, while BJP struggles to hit even triple digits.

By Round 23 it is all over.

AAP received 6878 votes in this round and the BJP just 5! AAP's Haji Yunus has now taken a comfortable lead of around 20,000 votes over the BJP and he cruises to victory.

Is this a technical glitch? A fraud? Manipulation in counting of votes? Was the election stolen? If you showed this sudden and extreme change of fortunes to anyone, they would suggest rushing to the Election Commission to file a complaint.

But, of course, the BJP, which is the losing party here, did not complain. They weren't even surprised. Surely that is because they understood the demographics of the area and expected nothing else.

After the BJP's defeat on Tuesday, we have been exposed to endless gyaan about how AAP worked miracles in education and health. What was this 6878 to 5 result about? Can you say seriously that it was about education and health? Remember that the BJP candidate was leading by around 30,000 votes until Round 14. How much disparity in education and health could there possibly be within a single seat in Delhi that we get a North Korea style landslide of 6878 to 5 in favor of AAP candidate Haji Yunus?

Every Indian needs to know what happened in Round 23 in Mustafabad in Delhi. Because it tells us what really lurks under the surface of Indian secularism.

In principle, voting allows us to decide who governs us. But a closer look shows that the electoral process forces us to make all sorts of difficult choices. The most basic of these is there while we may care about many issues, we get just one vote. When you break it down by candidate and by issue, you realize that it's a very complicated optimization problem. Also, there is the system. Do you vote for an MLA or a Chief Minister?

And then there are the unknowns. About a month after election results, people of Maharashtra found out that they had voted for a Congress government.

Similar problems would exist in every electoral system. More Americans voted for Hillary Clinton, but Donald Trump won anyway.

When you grapple with all these unknowns, you realize how fragile democracy actually is. And how easily it can be hijacked by single issue voters.. Which is likely what happened in Mustafabad.

A group of dedicated people who care about one and only one issue can easily overwhelm the majority. AAP's Haji Yunus probably has to do little on education and health and development. He knows his 6878 to 5 landslide victory has nothing to do with those issues. As long as he keeps his single issue voter happy, he is safe.

AAP's Amanatullah Khan won from Okhla by a huge margin of almost 1 lakh votes. Is Okhla the most prosperous part of Delhi, with the best schools and hospitals? Probably not.

This is not just a Delhi phenomenon.. Hyderabad is one of India's top metros. Since 1989, it has been under the control of the Owaisi family that runs MIM. How can a vibrant metropolis be under the thumb of a party like MIM? Anyone will tell you that it's because MIM controls the "old city" of Hyderabad.. The old city area does not lead in education and health: in fact it is the poorest part of the city. But that matters little, because the area is full of single issue voters. On a side note, when was the last time you heard a liberal complain about the polarization that allows MIM to keep Hyderabad?

Yes, the people of Delhi wanted AAP this time. Even if BJP had won Mustafabad, there was no stopping Kejriwal. But elections come and go. Single issue voters stay exactly where they are. The rest of the public goes through mood swings. Ultimately, the single issue voter, who never changes their preference, will prevail. The system is designed to reward such behaviour.

Each time, the single issue voter tries to get a bit more space for their cause. Sometimes they may succeed in pushing ahead. Sometimes not. If their party doesn't win this time, they wait at the same point for five years and try again. The takeaway is that they are never in retreat. Over time, they will prevail.

Think about Shaheen Bagh. The media has stopped covering them now. By all accounts, the supply of Biryani, whether 'kudrati' or otherwise, seems to have run out. But remember that this crowd watched and cheered as a mother slowly dragged the life out of her 4 month old baby. Day by day, bit by bit, slowly and painfully. The cheering crowd has no regrets. The mother has no regrets. In fact, she has become a hero. Absolutely chilling crime against humanity committed in cold blood. This is the level of commitment that the single issue voter brings to the table.

Perhaps you are not among the single issue voters. You may have different priorities. You might be willing to strike a compromise with the single issue voter for the time being. Fine, but remember that the compromise will always come from your end. Expect no compromise from the other side. If a mother is willing to part with the life of her baby for the sake of her cause, what could possibly make her change her mind? She has already beaten the strongest instinct in all of nature, drilled in by millions of years of evolution. You stand no chance of convincing her. The single issue voter will not move back one inch and will not stop until they win 100%. It may take five years or hundred years, but the single issue voter will prevail.

Religion and patriotism are both evil. Patriotism especially in India is only 70 years old whereas religion is in the blood of everry human being for the last 40000 years and more. Let me start my open letter with an honest and unapologetic confession – I have been taught by family to love my Bharat Mata more than Mother Church. Having said that, let me also state that I love and respect the Mother Church too. To my family – our nation is first, our religion comes second.

I am a firm believer and an ardent disciple of the teachings of Jesus but I am also a staunch critic of the hypocrisy of the leaders of the Catholic Church. My research into the demonic stance of the leaders of the Catholic Church on the grave crimes of sexual abuse of children, nuns and vulnerable adults committed by priests and bishops has shown me of face off the Catholic Church that is horrid.

Another horrid face of the leaders of the Catholic Church that I have been seeing over the last six years since the Narendra Modi-led BJP government has come into power is a determined effort of the Church leaders to spread fear and hate in the hearts of the Christians in India.

I have questioned the leaders of the Catholic Church numerous times to prove the allegations that Christians are in danger in India. I am a Christian. I do not feel that I am in danger in India. India is my motherland. I am not afraid to live in my own motherland. No Indian needs to be afraid in India.

So let me be truthful without being rude or infringing on your freedom of thought and speech. Your statement on the CAA as an Archbishop of the Catholic Church is biased, misleading and should be seen as an act of divisiveness bordering on spreading hate subtly in the minds of the minorities against the current government in India.

I strangely remembered this in the Bible John 8:44, "When he speaks a lie, he speaks from his own resources, for he is a liar and the father of it."

In your letter issued on February 8th 2020, you have categorically stated, "The ongoing expressions of widespread discontent and open protest taking place throughout the country, and even abroad, with regard to the recently passed Citizenship Amendment Act (CAA) as well as the proposed National Register of Citizens (NRC) and the intended National Population Register (NPR) are causing great concern and anguish to millions of Indians spread throughout the globe. The protests demanding that the CAA be revoked immediately and that the countrywide NRC and the NPR be desisted from are on the increase. Eminent citizens, including top intellectuals and legal luminaries, have taken a studied and unequivocal stand against them. Here in Goa too we have witnessed several protests which transcended the confines of religious and caste affiliation and have brought people from all walks of life together, on one united platform."

So let me debunk your misleading narrative. The widespread discontentment messages on CAA you talk about are being spread by politicians in the Opposition, Islamic Radicals and the Catholic Church itself. It is not a people's movement like the India Against Corruption, these are well-planned protests against India.

In numerous protests across of the country; violence, riots and arson of public and private property were adopted.. This was completely out of an Islamic Radical Handbook. In fact deep investigations into protests in different colleges in India and Shaheen Bhag is exposing the handiwork of Islamic radical organisation.

If people feel that a law ought to be revoked, they have law at their behest to change a law. No one needs to resort to violence, arson and inconvenience to other citizens.

Just to educate and inform you: The central intelligence agencies have traced links of most of the #AntiCAA protests to a radical Islamic organisation known as Popular Front of India (PFI).

PFI is banned in Jharkhand and several states have petitioned the Ministry of Home Affairs (MHA) to ban this controversial organisation, that is reportedly known as the new organisational face of SIMI – a banned organisation linked to terror groups working against India from within and out of India.

PFI is also linked to violence and deaths of Hindus and Christians across India.

The PFI group is also reportedly linked to #LoveJihad cases in Kerala. In fact the Syro-Malabar Church in a recent statement shockingly revealed that their study into the #LoveJihad cases involving Muslims boys and Christian girls could be over 4000 cases. The Syro-Malabar Church has even petitioned the Prime Minister of India to address the growing concerns of #LoveJihad in the state.

But of course as the Archbishop of Goa you will never talk about PFI because you would have categorised the Islamic radicals as intellectuals and legal luminaries. Otherwise it would be very difficult to explain to the people of India the links between the Catholic Church in Goa and PFI.

Catholic Priests representing the Catholic Church in India and belonging to Church organisations have frequently shared the dias and spoken at the PFI Convention in Goa.

At the PFI Convention held in 2017, Fr Savio Fernandes who is an office bearer of the Centre for Social Justice and Peace (CSJP) on stage stated, "Our rights are not safeguarded, if we speak anything against the government, you are declared as terrorist'. Illegalities in all forms have become order of the day in the present government."

A Catholic priest sharing a stage at a PFI Convention spreading fear stating, " If you speak against the government, you will be declared as terrorist.".

Don't be surprised. This quote is not from a figment of my imagination but from the PFI website on the PFI Convention held in Goa in 2017.

I am curious to know Archbishop Ferrao who in the last six years in India has been declared as a terrorist in India by the ruling government or by the people of India just for opposing the government. Compare that to the unfair treatment meted out by the Catholic Church to the nuns fighting Bishop Franco Mulakkal who is accused of raping one of the Nuns from their religious congregation 13-times. They are being treated Das outcaste and traitors. And the Catholic Church is lecturing us Indians.

If PFI is proved to have links with terrorist organisations would it be safe to assume that the Catholic Church in Goa that has a close proximity with PFI should be also investigated for such links.

Coming back to the moot point on CAA.

In your letter you state, "The very fact that the CAA uses religion goes against the secular fabric of the country. It goes against the spirit and heritage of our land which, since times immemorial, has been a welcoming home to all, founded on the belief that the whole world is one big family. With regard to the NRC and the NPR, there is a serious concern that such exercises will result in a direct victimization of the underprivileged classes, particularly the Dalits, the Adivasis, the migrant labourers, the nomadic communities and the countless undocumented people, who, after having been recognized as worthy citizens and voters for more than seventy years in this great nation, will suddenly run the risk of becoming stateless and candidates for detention camps in their teeming millions."

The above statement is pure hate-mongering.

The spirit and heritage of India is to open its doors to the persecuted people. That is exactly what the government did through the CAA. It has shown its humanitarian Indian spirit and reached out to the persecuted minorities in Pakistan, Afghanistan and Bangladesh.

If you are trying to tell the people of India that we should open our doors to the majority of Muslims in Pakistan, Bangladesh and Afghanistan who are not persecuted. Then may I remind you that the Muslims in Pakistan and Bangladesh had a choice to stay in India or go separate. They rejected India and followed their religion in the newly formed nations.. So there is no need for them to come back to India because they are not Indians. If some still chose to want to be Indians, then can come through the naturalisation process because they are not persecuted minorities.

I am of the opinion and with much humility I state is that neither have you read the Constitution of India nor have you read the Citizenship Act of 1955 especially Section 14 (a) nor have you read the Citizenship Amendment Act 2019. If you would have read it, detail for detail, you would know that it is not discriminatory to any religion in India and neither to any Indian..

Your hate-mongering on NRC and NPR is absurd simply because NRC in Assam was a direction of the Supreme Court, the Indian government has not even initiated a process or law for NRC. NPR is legal process that a government can adopt as per The Citizenship Act of 1955, Congress led UPA government also adopted NPR. The Catholic Church did not raise an objection on NPR then. It befits an important question why question a legal tenet like NPR now when BJP is in government.

I am also curious as to why the Catholic Church failed to raise a hue and cry when UPA-2 government issued this notification:

Under Rule 3 of the MHA document, it states, "Following class of persons have been exempted from the provisions of rule 3 of the Passport (Entry into India) Rules, 1950 by Notification S.O. No.1115 (E) dated 15.5.2010 issued by the Central Government:-"Male Muslim community member being originally Indian citizen went to Pakistan after partition leaving behind family in India and returned back to India and settled in the State of Kerala on a valid passport issued by the Government of Pakistan which has either been expired or lost and – (i) such person has gone to Pakistan between the period of 15th August 1947 and 31st December 1965; (ii) such person should not have married while in Pakistan; (iii) such person should not have acquired any immovable property in Pakistan; (iv) such person, while going to Pakistan, should have left behind family members who are Indian citizens; (v) such person should have no intention whatsoever of returning to Pakistan; (vi) such person should have any adverse report from the police and security agencies.State Governments / UT Administrations may consider cases for extension of the LTV of such persons covered under the Notification S.O. no. 1115(E) dated 15.5.2010 under their delegated powers without insisting on validity of passports."

I have said this before and I repeat it again the Christians are not in danger in India, if they are in danger, then it is in the Catholic Churches across India which keep silent on the numerous cases of sexual abuses by priests and bishops of children, nuns and vulnerable adults.

I am certain Archbishop Ferrao, you will never open your mouth against the crimes of the Church within the Church. In the Bible, Matthew 7:5 it states, "Hypocrite! First remove the plank from your own eye, and then you will see clearly to remove the speck from your brother's eye."
