NRC in Assam
- In 1985, Rajiv Gandhi goofed up on two accounts in Assam, which created a recipe for humanitarian disaster.
- First goof up. For political expediency, he agreed to the demands of the agitating All Assam Students Union (and later Asom Gana Parishad) without opening up a more challenging dialogue that was required to bring in the vision for a future of India into the 21st century and beyond.
- If in late 20th century any community felt threatened by the influences of other cultures settling in their locality that needs to be considered appropriately, thoroughly discussed in the right perspective and solutions created. Given that we are moving more and more into a multi-ethnic, multi-linguistic, multi-religious, and multi-racial civilization, autarky of any culture is not only not possible but also needs to be addressed in a manner that seeks not to eliminate mixing of cultures but supports mixing in a manner that enriches both.
- There was no provision in the accord to grant work permits to long-term residents so that working populaces could continue make their living as they had been doing for years, if not decades.........
- Instead the pact created the need for pushing people out of employment and into detention camps, which would burden the Indian tax payers!
- To address such issues Rajiv Gandhi and the Congress needed to be visionaries and deeply committed to multi-ethnic, multi-linguistic, multi-religious, and multi-racial vision for India and the world. (Aside: Singapore under Lee Kwan YEW addressed this challenge in 1965 when suddenly Singapore was pushed out of Malaysia. Angela MERKEL has taken up a similar challenge in Germany where she is considering to settle 800,000 immigrants from the middle east – a huge challenge for any nation. That's what the future of our planet urges us to do; re-think communities, rights and duties of minorities and find innovative solutions that have never been considered before. In general, post-WW2, people are much more mobile, which will grow not lessen. In addition, the climate crisis will force migrations by the millions!)
- Second goof up. A nation and society that has rarely issued birth and death certificates, and other documents related to residency permits, employment permits, and still struggles to do so, going straight from registration of people to identification of citizenship was foolish nightmare, designed for failure and utter chaos. All these essential processes must be in place and working effectively and efficiently before the big jump from registration of residents to citizenship determination is made. (Aside: An investigative journalist once published his own death certificate to highlight how corrupt our system is in India.)
- The previous register was created in 1951 and had not been updated when this 1985 accord was put in place. The result was an utter chaos. Fast forward to August 2019, 1.9 million people were found to be non-citizens out of a total of approx. 33 million residents. Of these 1.9 million, 0.7 were Muslims and rest were hindus.
- The "flawed" results shook everyone! Many persons of prominence – including a sitting MLA – were now no longer Indian citizens! Kargil war veterans were no longer Indian citizens!
BJP Enters the Fray
- This was now an opportune moment for BJP, RSS, VHP to enter the scene. And, true to their narrow-mindedness they came up with a double-flawed solution to ensure that no Hindu (especially) could be declared a non-citizen of India. To this a few other non-Muslim religions were added – Buddhists, Christians, Jains, Parsis, & Sikhs.
- Capitalizing on an already flawed process, a double flawed process was set in motion by BJP, which has the recipes for humanitarian disaster of much larger proportions.
- There is no provision again for granting employment permits for those who are suddenly going to be declared non-citizens. Hard working residents will suddenly find themselves in detentions camps.
- CAB ignores all the persecuted from our neighbours, including the long settled Tibetan refugees in many cities across north India.
- While the supreme court will decide the constitutionality of CAB, and there are many moot points that the court will have to reasonably settle (especially against Article 14 and "Reasonable Classification"), this law is clearly against the spirit of our constitution, discriminating against a particular religion.
- Leaving out any community from the protection of law, or leaving them out from 'Right to equality before law' or from 'Equal protection of law' cannot pass the test of "Reasonable Classification". (explained below in more detail)
- As a special law, CAB needs to protect every resident in India, whether they are citizens or not. Article 14 extends equality before law and right to equality to every resident in India.
False Claims by BJP
- Advocates of CAB, especially the BJP leaders, have claimed that the CAB is being passed and implemented to support persons who face religious persecution in neighbouring countries. It is well known that there are Muslim communities being persecuted in Pakistan, Myanmar and China. Tamilians have been persecuted in Sri Lanka, Muslims and atheists are persecuted in Bangladesh (Taslima NUSREEN of Bangladesh, a well-known litterateur of Bangladesh has had to seek Sri Lankan citizenship because India refused to grant her citizenship). CAB deliberately wants to ignore them all and focus only on Pakistan, Bangladesh and Afghanistan.
- Consider a hypothetical possibility that U.S.A., Canada and western nations decided that all religions will be granted work permits and also citizenship but not hindus. How would hindus from India (especially) and from other countries react? Welcome such laws?
Here is a primer of the context:
① What is religious persecution? Harm beyond harassment or basic discrimination – harm amounting to persecution which can be due to cumulative discrimination or harassment as well, usually physical harm or violation of fundamental rights that is faced by people on the grounds of their religion or sometimes the religion they are assumed to follow (whether they do or not).
② What framework does the CAB provide for addressing victims of religious persecution? It does not provide any. There is no framework or standard for deciding who qualifies. THE CAB DOES NOT ATTEMPT TO IDENTIFY OR LET PEOPLE SELF-IDENTIFY THAT THEY FACED OR EXPECT TO FACE IN FUTURE ANY RELIGIOUS PERSECUTION. It does not have a framework for processing these claims, for verifying it, for adjudicating who is a refugee due to religious persecution – it only states who should become citizens from neighbouring countries. The CAB basically skips any attempt to address the very thing it claims to address.
③ Why not Atheists or Muslims? According to BJP leaders since the 3 countries are Muslim-majority, Muslims don't need asylum. This is patently false. The US was settled by boatloads of pilgrims who were Christians escaping Christian countries. RELIGIOUS PERSECUTION DOES NOT HAPPEN ONLY ACROSS RELIGIONS BUT ALSO WITHIN RELIGIONS – consider Bahujans, Dalits and Adivasis who are apparently within the fold of Hinduism and yet oppressed and persecuted for millennia and are still being hounded by MANUvaad / BRAHMANvaad !
④ Similarly, Shias are directly targeted by Taliban and ISIS in Afghanistan and Pakistan, where they have been massacred, including specific Shia festivals being bombed, Shia "Takia Khana"s have been attacked and Hazaras who are not even Shia are assumed to be Shia and killed! The same is true of Ahmaddiyas in Pakistan.
⑤ Shias are being given asylum in Canada, who follow the Aga Khan and are seen as non-Muslim by many Sunnis and their leaders. This has been deliberately ignored by CAB.
⑥ Myanmar is seeing persecution of Rohingyans and Christians. Bibles were banned in the country, and Christians have been flocking to India for many-many years to escape persecution.
CAB, therefore, is in violation of the very principles of "equality before law" and "right to equality".
- CAB does not pass the tests against constitutional violations:
① Is this discrimination against a single community REASONABLE? (persecuted population in our neighbouring countries cannot be classified either on the basis of varna or jaati, or religion, or race or ethnicity or language or gender)
② Is it JUST? (antipathy against Muslims cannot be a JUST cause)
③ Is it ARBITRARY? (antipathy against Muslims and ignoring refugees from Myanmar and other neighbouring countries is clearly ARBITRARY)
④ Is any community being given SUPERIOR or INFERIOR status deliberately? (there cannot be cherry picking on the basis of varna or jaati, or religion, or race or ethnicity or language or gender to decide who among illegal immigrants can be granted Indian citizenship)
BJP's Bigger and Deeper Design
This bigger design of BJP, RSS and VHP is starting to unfold.
- There are much bigger and deeper designs that we need to recognize and be aware of. The more Modi pays obeisance to Ambedkar the greater the threat to Indian constitution.
- Ambedkar's constitution is one of the walls that stands between Indian people and MANUvaad / BRAHMANvaad which is repeatedly trying to rear its ugly head. Ambedkar's constitution is one of the key guarantees that stands to prevent institutionalization of strong discriminatory and illegal practices against Dalits / Bahujans / Adivasis that continue to plague India.......
- This bigger design is, therefore, to uproot Ambedkar's constitution and replace it with one that sits comfortably with MANUvaad / BRAHMANvaad.
- CAB has been designed to reinforce Jinnah's two-nation theory, which RSS, VHP and BJP's predecessor Jan Sangh has always subscribed to.
- BJP's / VHP's / RSS' hatred for Indian Muslims is immensely more because bulk of Indian Muslims are converts from the already oppressed sections of Dalits and Bahujans – the so-called "single born" people.
- If the key provisions of Ambedkar's constitution are gradually eroded away, it will be a matter of time before a draconian, backward looking MANUvaad / BRAHMANvaad is put in place, reinforcing:
① An unscientific world view;
② Promotes discriminations against women; and
③ Promotes discriminations against the so-called "single born".
- Combine MANUvaad / BRAHMANvaad with the FASCISM's ultra-nationalism and dictatorship of the powerful over people, India will be a living hell for the poor, the Dalits and Bahujans, and for faiths other than Hindu.
- Can we imagine pushing 20 million or so people (2 Crore or more!) into detentions camps all over the country? Given our track record of ill-treating weaker sections, it simply horrifying to imagine what it will be like with 20 million languishing in detention camps!
- Mob lynching, complicit police force are already in play in the streets of India. A weak and a corrupt state, is now being thoroughly manipulated to put fear into the hearts of those who would like to criticise and oppose BJP, RSS, VHP.
- Almost every criticism is now being categorized as "unpatriotic" accompanied, in many cases, with the retort 'go to Pakistan' or threats of physical harm. The ULTRA-NATIONALIST nature of this regime is now starting to become venomous.
- Police action is now overtly against the victims and not against those who are perpetrating violence on Dalits / Bahujans / Muslims.
Is NPR a constitutional violation of any kind? It is NOT a violation but we need to note that NPR does not follow from the Census Act of 1948. Nor does it follow from the Citizenship Act.The anxiety that follows from NPR is a click away from NRC.
The additional 8 new questions added to the 2010 NPR, now requires those who were born after July 1st, 1987, to also declare their parents' place and date of birth. Wonder, how many Indian residents know their own parents' place and date of birth? Ours is still a nation that continues to be governed by an administrative cadre, the IAS, most of whom have the mind set of that of a tax collector divorced from the residents / citizens of this nation. For the past 70 years we not put in place simple and MUST HAVE processes that will automatically register the dates and places of birth of those born in India, whether they were delivered in a hospital or in village homesteads or on the streets of some Indian city.Lastly, CAB violates BJP's own stated position of uniformity of civil codes for all communities irrespective of religion.--First they came for the socialists, and I did not speak out— Because I was not a socialist.
