Hi, My friend Subi Samuel stated that some Passenger carried INR 25,000/- and 65 Tola Gold Jewellery
in the checked baggage was lost.  First and foremost, in the checked-in piece one must not carry
any valuables/documents etc. If carried and same is lost the carrier is not at all responsible and this is
clearly stated in the terms of contract of carriage appearing on the paper ticket previously issued to a passenger.
I am sure the same must be even on the electronic paper ticket and if not on the website of the carrier.  Further,
even when one  loses the cabin baggage one cannot claim any compensation for loss in normal cases as it is in the custody of the passenger.  Such a claim will only be entertained in emergent cases like plane crash etc.
Further I am not sure if one could carry INR 25000/- out of India in contravention of the Customs Rules in
force.  Persons in the know could throw light in the matter. Mr Abdul Latheef Puthenveedu there is no point
in blaming the AI or IX officials as they have to follow Rules and Regulations in force. Just as you cannot
overlook these considerations if you are in their shoes, similarly they also cannot close their eyes and lavish
largesse. Further when you are writing you are in the public domain.  Please bear in mind not  to use abusive language and refrain  from making unsavoury comments as these are not going to get you anywhere.

Dear Firends,
 
I have something to tell about this. Each and every aircrafts are insured with major insurace which includes Passengers and crew members life as well. So Air India (AI) or Air India Express (IX) cannot escape from that. But we should find about the break up of sum insured amount. Most of the Indian based airliners are operating with Boeing 737-800 (Passenger capacity is 182) or Boeing 737-800ER (Extra Range) (Passenger capacity 182-212). But this particular equipment was B737-800. As per CVR (Cockpit Voice Recorder) this accident was not happened because of any natural calamaties like Fog, Cross wind or some thing like that. It is very clear that the first officer told captain to abort landing at the flight level of 2000ft which was simply possible. So human error also there. So calculation of compansation should be considering these factors also.
 
Another suspecting cause for this accident was the malfunctioning of ILS(Instrument Landing System) which will allow the aircraft to line up with runway. Remember that most of the commercial aircrafts whether it is Boeing or Airbus have sofisticated automation systems in the industry. So this ILS story is not reliable in this case.
 
Now I would like to discuss about the market fares. As per one of our member told that IX is not and IATA member. IX is the two letter code of Air India express which is provided by IATA. But not a GDS carrier. As he mentioned airlines are not bothered about IATA rules is some how correct. The reason is todays market most of the passengers are paying carrier specific fares not IATA fares. Everybody looks at cost part so all airlines has to reduse their fares so now days in economy class itself there are 8-15 sub divisions are there with different fare level. The highest level economy fare is IATA fare which is fully flexible. If u cancel ticket or make date change most of the time passenger will not loose anything. But no one will pay for these kind of fares. Eg: As you aware if lowest starting fare on Emirates Airline4s (EK) Dubai - Cochin is AED.850.00 this is Economy Class carrier specific fare which have lot of restrictions. Some times non-refundable also. At the same time there is same economy class is available for AED. 2500.00 which is IATA fare and fully flexible. If u want to cancel u will get full refund and many more advantages. Both are economy class ticket only but we will prefer only carrier fares. So this is what happening in the market thats y IATA also have to keep silent. This is about normal air line.
 
if we look in to LCC(Low Cost Carriers) like Air India Express, Spice Jet, Indigo, Airarabia, Fly Dubai etc are mostly cheaper than normal airlines. So they are not bothered about certain rules and we cannot question them also.
 
Again we look in to Insurance part I strongly recomend all of you to take Travel Insurance also which will cover lost of baggae, life, medical emmergency. flight delay etc. Most of the agencies can issue Travel Insurance immediately while issueing ticket and you need to pay a few amount additionaly for that. May be 50-100 Riyal or Dhirams. Because mostly we used to travel Transit flights and we used carry several kinds of valuable materials to Kerala. There are several cases reported in this seaon itself about lost baggage, theft, dammage, flight delay at transit point like that. All these situation can be covered with travel insurance.
 
Warning : There was an incident happened Cochin to Dubai Air India Express flight few weeks back. A family traveled from COK - DXB on IX flight. They are staying in Sharjah. After reaching their Flat in Sharjah they opened their baggage they found that they have lost INR. 25000 and 65 Pawn Gold Ornaments from there baggage. But there was no sign or damage on their bags. This Vedio has been uploaded on Face Book and it bacame very popular now. many people have shared this VDO. Its very clear that this Burglary was happened in side the airport may be at Cargo or Loading section. Very careful when u are using a bag having Zip. It can be opened with a ball pen and take the valueables out. After that just slide the zip back in position there will not be any sign of theft. So again travel insurance is very important.
 
Few weeks back one of our member posted a mail regarding the problem of certain equipments at Cochin (COK) airport. As per that mail "COK airport does not have Radar" which is wrong and I send a replied for that also. There are several kinds of radar in an airport. We should find out what kind of radar he was talking about. If it is whether forcast radar there is a chance for hard landing. As all of you aware today early morning also there was an accidend happened in COK airport. Gulf Air (GF) flight over shooted from the runway after landing and 2 people were injured and the asircraft has sivior damage.
 
These kind of situation should be avoided in future as a Keralite we all are using all these major 3 airports in Kerala so this is a question about our life and security. So we should
take a step to sort out these kind of problems.

Passengers will decide in which flight they have to travel. Air India should have manner and morale to issue the insurance amount to the victims, immediately. It should be according to the rules and regulations.

The beastly behaviour of Air India is deplorable. Keep in mind that these notorious officials and their family are eating from the national ex-chequer. In other way, these rascals are eating the shit of the people.

When  it suits people they want IATA norms to apply but when it comes to the fares they do not want IATA to
 be anywhere in the picture.  Does the writer think that IX is a member of IATA. These days who cares for
IATA.  Airlines do not care for IATA and they flout all the Rules.  This is what is wanted by the public.  They
want very cheap fares but when it comes to other benefits they want the same in full.  Why this Greed. Most Keralites were patronising GF.  Why they stopped going on GF.   Why this sudden love affair with AI..Could anyone throw some light.

This Division bench verdict is unfortunate. It is likely to create new dimensions in the Insurance field. A passenger,whether he is a labourer or a n executive, whether he is aged 30 or 60, paying the full amount of ticket to the airlines. No airlines is offering discounted ticket for low income traveller or to the aged traveller. As such how can the compesation for an unfotunate t tragedy for which only air india is responsible, considered in different norms. Some of the verdicts given by our judges make us believe they are not having humanity considerations. Air India or the courts dont feel shame to create agony for the unfortunate victims of a tragedy. As far as I know, the compenstions should be paid as per the IATA rules. Is the Division Bench verdict in line with the IATA terms & condition? Those who know about the IATA rules, are requested to clarify.
Another likely is that Life Insurance companies also may tell the same thing tomarrow. They may also calculate the amount to be paid according to the position of the insured person & the number of years he has survived.
Any how I feel that there should be a move from all the Pravasi organizations t o support the relatives of the victims. Today it is their turn; tomarrow it can be ours. Government of India or Air India or the Insurance companies should not be allowed to cheat the victims of the tragedies. We will sign a memorandum & send it to the authorities concerned.

Hundreds of question raises. I feel the judges are drunkards or corrupted. Policy amount decided by premium amount. All paid same amount for Air Fare. Then who are these judges and Air India rascal directors to decide the age, salary and social status etc.
If anyone can, take arm and protest. That is the only possible way in India, where Judiciary and rulers are corrupted. Be ready to sacrifice for JUSTICE.
